Law Commission - Enforcement of Family Financial Orders

The Law Commission consultation considers the various means by which court orders for financial provision on divorce or the dissolution of a civil partnership and orders concerning financial arrangements for children are enforced. It will not touch upon the basis for claims, but will consider the legal tools available to force a party to comply with the financial orders made under the Matrimonial Causes Act 1973, the Civil Partnership Act 2004 and the Children Act 1989.
The current law has been described as "hopelessly complex and procedurally tortuous".
The consultation proposes to offer a clear set of rules and the opportunity to access the full range of enforcement options in the same court and without the need for multiple hearings.
We would like to hear from CILEx family practitioners in order to inform our response to the Law Commission paper. The deadline for submission is 11 July 2015. However, we would like to hear your views before the week ending 19 June 2015.
